ABC Urges Withdrawal of Davis Bacon Rule |
In a comment letter filed on May 17, Associated Builders and Contractors urged President Biden’s U.S. Department of Labor to withdraw an inflationary and flawed proposed rule revising Davis-Bacon Act and Related Acts regulations that apply to federal and federally assisted construction projects funded by taxpayers.
“The DOL’s proposed rule does little to improve or modernize Davis-Bacon Act regulations in the face of decades of complaints by government officials, taxpayer watchdogs and industry stakeholders critical of this regulatory boondoggle well-known for increasing the cost of construction, discouraging competition from small businesses and diminishing the value of taxpayer investment in government infrastructure projects,” said Ben Brubeck, ABC vice president of regulatory, labor and state affairs.

ABC Opposes New Employer Penalty Bill |
ABC recently sent a letter to the U.S. House Education and Labor Committee in opposition to proposed legislation that would levy heavy penalties against employers for inadvertent overtime and pay violations under the Fair Labor Standards Act. H.R. 7701, the Wage Theft Prevention and Wage Recovery Act, was marked up and approved by the committee last week and seeks to enforce FLSA compliance by imposing potentially devastating penalties that would result in lengthy, costly litigation and could bankrupt many smaller businesses for potentially inadvertent overtime and minimum wage violations. The new legislation would propose new and increased back wages, liquidated damages, civil penalties, and criminal penalties, including liquidated damages of up to three times back wages, and civil fines up to $110,150 per employee. |
